Florida Residential Lease Agreement Template
This Florida Residential Lease Agreement (hereinafter referred to as the "Agreement") is entered into this ___ day of ____________, 20__, (the "Effective Date") by and between ___________________________ (the "Landlord") and ___________________________ (the "Tenant").
Whereas, the Landlord is the legal owner of the residential property located at _____________________________________________, Florida (the "Premises"). This Agreement is intended to outline the terms and conditions under which the Premises will be leased to the Tenant.
1. Term of Lease
The lease term shall commence on _______________, 20__, and shall expire on _______________, 20__.
2. Rent
Monthly rent shall be $____________, payable on the first day of each month. The Tenant shall make payments to the Landlord at the address mentioned below or through any other method agreed upon by both parties:

3. Security Deposit
The Tenant agrees to pay a security deposit of $____________ before moving into the Premises. This deposit will cover any damages beyond normal wear and tear, unpaid rent, or other obligations not met by the Tenant. As per Florida Statutes Section 83.49, the Landlord will return the security deposit, minus any lawful deductions, within 15 to 60 days after the lease ends and the Tenant vacates the Premises.
4. Use of Premises
The Premises shall be used exclusively for residential purposes by the Tenant and their immediate family. The Tenant agrees not to use the Premises for any illegal activities.
5. Maintenance and Repairs
The Tenant is responsible for keeping the Premises clean and sanitary and to pay for any damage caused by their negligence or misuse. The Landlord is responsible for ensuring the Premises are in habitable condition, in compliance with housing regulations.
6. Alterations
The Tenant shall not make any alterations, additions, or improvements to the Premises without the prior written consent of the Landlord.
7. Utilities
Unless otherwise agreed, the Tenant is responsible for all utilities associated with the Premises including but not limited to electricity, water, gas, telephone, cable, and internet services.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this Agreement shall be adjudicated in the state or federal courts located in Florida.
9. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior understandings or agreements. Any amendments to this Agreement must be in writing and signed by both parties.
