Florida Commercial Lease Agreement Template
This Florida Commercial Lease Agreement (the "Agreement") is entered into as of __________ (the "Effective Date"), by and between ____________, with a mailing address of ____________ (the "Landlord"), and ____________, with a mailing address of ____________ (the "Tenant").
Witnesseth, that whereas the Landlord is the rightful owner of the property situated in ____________, Florida, legally described as ____________ (the "Premises"). The Landlord desires to lease the Premises to the Tenant, and the Tenant desires to lease the Premises from the Landlord for the term, at the rental, and upon the conditions set forth herein.
Now, therefore, in consideration of the mutual promises herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:
1. Term
The term of this Agreement shall commence on __________, and shall terminate on __________, unless sooner terminated pursuant to the provisions hereof.
2. Rent
The Tenant agrees to pay the Landlord __________ per month as rent for the Premises, payable on the first day of each month in advance, without notice or demand. The first month's rent is due upon execution of this Agreement.
3. Security Deposit
The Tenant shall deposit with the Landlord the sum of __________ as a security deposit to guarantee the Tenant's faithful performance of the terms of this Agreement. Upon termination of this Agreement, the Landlord will return the Security Deposit, minus any deductions for damages, unpaid rent, or other charges as provided in this Agreement.
4. Use of Premises
The Tenant shall use the Premises solely for commercial purposes and in compliance with all applicable state, local, and federal laws, including but not limited to all Florida-specific laws and regulations.
5. Maintenance and Repairs
The Tenant will, at their own expense, keep and maintain the Premises in good, clean, and sanitary condition and repair during the term of this Agreement and any extension thereof. The Landlord has no responsibility to repair or maintain the Premises unless specifically agreed in writing.
6. Modifications and Improvements
Any modifications or improvements made by the Tenant to the Premises shall first require the written consent of the Landlord. All improvements to the Premises, whether temporary or permanent in character, shall become the Landlord’s property and remain on the Premises at the expiration or earlier termination of this Agreement.
7. Assignment and Subletting
The Tenant shall not assign this Agreement or sublet any portion of the Premises without the prior written consent of the Landlord, which consent shall not be unreasonably withheld.
8. Governing Law
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Florida without regard to its conflict of laws principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings, agreements, or representations by or between the parties, written or oral, to the extent they relate in any way to the subject matter hereof.
